 TERMS & CONDITIONS

These Terms and Conditions explain your rights, obligations and responsibilities and those of your contractor. A contract is a two-way arrangement and it is important that everyone knows where they stand. Where we use the word ‘you’ or ‘your’ it means the customer: ‘we’ or ‘us’ means UK SHOPPING IN SPAIN.COM These conditions can o­nly be changed or amended by our written agreement. Please read them before ordering as completing the order form means you accept these Terms and Conditions.

1) GENERAL OBLIGATIONS

UK SHOPPING IN SPAIN

In relation to the o­nline ordered goods, UK Shopping in Spain undertakes to move the goods with the carrier of its choice not more than approximately two weeks after delivery to our UK warehouse.

CUSTOMER

It will be your sole responsibility to

a)tell us the total value of goods to be delivered

b)give us a contact telephone number for correspondence during transit or storage of the goods

c)ensure proper protection for goods left unattended at a premises under your command or where other people will be present(eg workmen, tenants etc).

d)pay in full before we deliver to you

e)carefully check the Terms and Conditions of each website retailer´s before you place an order.

f) UK appliances such as fires,cookers, TVs etc must be checked in advance of purchase by you for Spanish compatability.UKS takes no responsibility for this.Any items purchased in the UK which have to be returned to the UK because they are not suitable for Spain will be charged at the full return cost. 

UK Shopping in Spain take no responsibility whatsoever for any other website or o­n-line shop.

Other than by reason of our own negligence, we will not be liable to any loss or damage or additional costs that may arise by these matters.

PLEASED NOTE: OUR GOODS IN TRANSIT INSURANCE DOES NOT COVER ITEMS WITH GLASS!

ITEMS WITH GLASS WILL BE TRANSPORTED AT YOUR RISK!!

2) OUR FEE/INVOICE

Our fee includes: handling costs, packaging and transport. The fee charged will be in Euros. Payment will o­nly be accepted by cash, or credit/debit card. At the express demand of the Customer, "UK SHOPPING IN SPAIN" will issue an invoice.

3) QUOTATION

Our quotation is based o­n a fixed pricing structure. This excludes assemble furniture which is quoted for individually.It does not include additional costs such as insurance, custom duties and inspections or any other fees payable to Government bodies.

We may have to adjust charges if any of the following occur:

a) our costs increase (or decrease) due to currency fluctuations, changes in taxations or freight charges.

b) there are events or delays out of our control

c) we have to store goods because you cannot collect them or they cannot be delivered.

In the above circumstances, you will pay the additional charges.

4) ADVICE AND INFORMATION

Advice and information in whatever form it may be given is given by UK Shopping in Spain for the customer o­nly. Any oral advice given without special arrangement is provided gratuitously and in good faith and without contractual liability.

5) SERVICES NOT INCLUDED

As our staff are not qualified to provide the following services, we recommend you employ a suitably qualified person separately to perform such tasks:

a) assemble unit or furniture (flat packed), fixtures or fittings

b) disconnect or reconnect equipment, appliances, fixtures or fittings

c) lay fitted floor coverings.

 

6) ROUTE AND METHOD

a)We have the full right to choose the route and method for delivery.

 

b)Unless it has been specifically agreed in writing o­n our Quotation, other space/volume/capacity o­n our vehicles and/or the container may be used for consignments of other customers.

 

 

DELIVERY TO ALL OTHER AREAS IN MAINLAND SPAIN 

 

 This depends upon the size and nature of the goods.

 The delivery time given to the Customer by us may vary depending o­n the area and distance involved. In case delivery is made and nobody is at the indicated address to accept delivery, the carrier shall leave a note indicating that it was unsuccessful in making the delivery. The Customer is personally liable for its choice of Products and after delivery is entirely responsible for the conservation and consumption of the products.

8) OUR LIABILITY FOR LOSS OR DAMAGE

Our liability for loss or damage is limited, as set out below. Subject to our express written agreement in advance of the Fees being paid and the additional charge paid, you may request that we increase our liability.

a) in the event that we damage or lose your goods, if we are liable, we will pay you up to a maximum sum of 100.00€ for each item which is lost or damaged

OR

b) we may choose to replace or repair the item. If an item is repaired we are not liable for any depreciation in value.

c) Other than for reasons of our negligence, we will not be liable for any loss, damage or failure to deliver the goods (or any consequences resulting from such failure) if it is caused by any of the following:

a) By fire howsoever caused.

b) By war, invasion, acts of foreign enemies, hostilities (whether war is declared or not), civil war, terrorism, rebellion and/or military coup, Act of God, industrial action or other such events outside our reasonable control.

c) By normal wear and tear, natural or gradual deterioration, leakage or evaporation or from perishable or unstable goods. This includes goods left within furniture or appliances.

d) By moth or vermin or similar infestation.

e) Electrical or mechanical derangement to any appliance, instrument or equipment unless there is evidence of external impact.

f) To jewellery, watches, trinkets, precious stones or metals, stamps, coins, or goods or collections of a similar kind, howsoever caused, unless you have previously given us full particulars with value, and we have confirmed in writing that we accept responsibility as in conditions 8(a) or 8(b) above.

9) SHIPPING TO A COUNTRY OUTSIDE THE UK

a) We use an international transport operator to move your goods from our UK warehouse to  either our Mojacar based shop or direct to you. We do this o­n your behalf and are subject to the Terms and Conditions set out by that carrier.

b) If the vehicle used by that carrier, should for reasons beyond the carrier’s control, fail to deliver the goods, or route them to a place other than the original destination(i.e. our shop), you have limited recourse against the carrier, and may be liable for General Average contribution (e.g. the costs incurred to preserve the vehicle and cargo) and salvage charges, or the additional cost of o­nward transmission to the place, port or airport of destination(i.e. our shop). These are insurable risks and it is your responsibility to arrange adequate marine/transit insurance cover.

iii) We do not accept liability for goods confiscated, seized or removed by Customs Authorities or other Government Agencies.

 

10) DELAYS IN TRANSIT

 

Other than by reason of our negligence, we will not be liable for delays in transit.

 

11) TIME LIMITS FOR CLAIMS

 

a) For goods which we deliver, you must note any visible loss, damage or failure to produce any goods at the time of delivery.

b) If you or your agent collect from our shop, you must note any loss or damage at the time the goods are handed to you.

c) Notwithstanding clause 6, we will not be liable for any loss of or damage to the goods unless a claim is notified to us in writing as soon as such loss or damage is discovered (or with reasonable diligence ought to have been discovered) and in any event within seven (7) days of collection of the goods from us or delivery of the goods by us, as the case may be.

d) The time limits referred to in clauses 8(a), 8(b) and 8 (c) above shall be essential to the contract.

 

12) PROHIBITED GOODS

 

All countries have different regulations for importing items from the UK. For example perishable goods cannot be sent to any country.

It is important therefore to establish whether the goods you have ordered are prohibitedor not.

a) UKS shall not be required or caused to carry or convey anything if such carriage or conveyance would be unlawful. The Company will not, without its specific agreement, carry livestock, liquids, perishable goods, glass, gases, pyrotechnics, arms and ammunition or corrosive, toxic, flammable, explosive oxidizing, or radioactive materials. The Company reserves the right to refuse any parcels which are neither the property of, nor sent o­n behalf of, the Customer.

b) The following items may be shipped but would not be covered by our liability cover:

Bottles, bulbs, camers, ceramics, chandeliers, china, chocolates, clocks, crockery, crystal, detergent, Dinner set, fiberglass, fish tanks, fluid, food and drinks, fragile items, framed paintings, glass, glassware, hamper, headlight, lenses, lights microscopes, microwaves, monitors, OHPs, ornaments, paint, pewter figures, pictures, picture frames, plates, porcelain, pottery, projectors, scanners, shower screens, spectacles, syrup,  TV´s, tail lights, tea sets, telescope, tiles, torches, watches, water, windows, window frames, wine.

13) OUR RIGHT TO HOLD/SELL GOODS

 

On giving you 28 days notice, we are entitled to require you to remove your goods from our custody and pay all money due to us. If you fail to pay all outstanding debt due to us, we are entitled to sell or dispose of some or all the goods without further notice. The cost of the sale or disposal will be charged to you. The net proceeds will be credited to your account and any eventual surplus will be paid to you without interest.

 

While we hold the goods and wait for payment, you will be liable to pay all storage charges and other costs incurred by our withholding your goods and these terms and conditions shall continue to apply.

 

14) DISPUTES

 

If there is a dispute arising from this Agreement, which cannot be resolved, either you or us, can seek independent legal advice. Until such time as this dispute is settled the goods remaining in storage or in transit or in both shall remain under the care of UK Shopping in Spain without further movement or client access.

 

 15)PRIVACY POLICY


Compliance with the Data Protection Act 1998 underlies all of our personal information privacy practices. We will keep your information that's necessary for us to provide you with a service you have requested for as long as it takes us to provide that service.

 

When you register with  UK SHOPPING IN SPAIN to use our shopping service:

 

a) You will be asked to provide certain information such as your contact details. We will store this data and hold it o­n computers or otherwise. We will use this data to fulfil our agreement with you.

b) We will keep records of any transactions you enter into with us for up to six years.  This is so that we can respond to any complaints or disputes that arise in that period

c) We will keep other information about you if it is necessary for us to do so to comply with the law

We endeavour to take all reasonable steps to protect your personal information. However, we cannot guarantee the security of any data you disclose o­n-line. You accept the inherent security risks of providing information and dealing o­n-line over the Internet and will not hold us responsible for any breach of security unless this is due to our negligence or wilful default.

16)UK SHOPS RETURNS POLICY

Always check the returns policy of each website/shop. UK Shopping inSpain will not be liable for any goods which cannot be returned for any reason.
Goods accepted for RETURNS by us will be sent back to our UK
based warehouse then o­nto the shop from where it was ordered. 
Our full Returns Policy should be consulted before returning any goods
